ORDER AND OPINION TERMINATING PROCEEDING
On June 23, 1987 the above-named landlord filed a petition
for administrative review of an order issued on May 22, 1987, by
a District Rent Administrator concerning the housing
accommodations known as 1468-1470 Midland Avenue, Bronxville, New
York wherein the Administrator determined that the landlord was
entitled to a rent increase based on increased operating costs.
The Commissioner has reviewed all of the evidence in the
record and has carefully considered that portion of the record
relevant to the issues raised by the petition for review.
This proceeding was commenced on May 21, 1986 upon the filing
by the landlord of an application for a rent increase based on
increased operating costs.
In the order here under review issued on May 22, 1987 the
Administrator granted a rent increase.
In its petition for administrative review filed June 23, 1987
the landlord alleged that the Administrator erred in the
computations and that it was entitled to a larger rent increase.
The landlord submitted documentation of its claim with the
petition for review. On or about June 23, 1987 the landlord
presented this same documentation to the Administrator.
Upon notice to the tenants the Administrator reopened this
proceeding under Docket No. YBG 810003 RP. On August 27, 1987,
the Administrator corrected the order here under review and raised
the permissible rent increase granted the owner.
The Commissioner is of the opinion that the remedy requested
by the landlord in this petition for administrative review has

been fully considered and granted by the Administrator. No
unresolved issues of law or fact are presented in this petition
for review. Accordingly, this petition is moot.
THEREFORE, in accordance with the Rent and Eviction
Regulations, it is
ORDERED, that this proceeding be, and the same hereby is,
terminated.
