ORDER AND OPINION REMANDING PROCEEDING TO THE RENT ADMINISTRATOR
This Order is issued pursuant to an order in a Article 78 proceeding,
Supreme Court, New York County, Index Number 24373/92, Justice C. Beauchamp
Ciparick, issued January 6, 1993, wherein the Division of Housing and
Community Review (DHCR) was directed to further consider its prior order
which had been issued July 1, 1992.
On April 25, 1990 the above named petitioner-tenant perfected the filing of
a Petition for Administrative Review against an order issued on February 2,
1990 by the Rent Administrator, 92-31 Union Hall Street, Jamaica, New York,
concerning housing accommodations known as 50 West 69th Street, New York,
New York, various apartments, wherein the Rent Administrator determined
that the subject building was not subject to the Rent Stabilization Law.
The Commissioner's July 1, 1992 Order found that the building had not been
substantially rehabilitated and was therefore subject to the Rent
Stabilization Law.
Based on the above-cited January 6, 1993 court order, the Commissioner is
of the opinion that this proceeding should be remanded to the Rent
Administrator for further processing including the opportunity for the
parties to submit further evidence.
THEREFORE, in accordance with the Rent Stabilization Law and Code, it is
ORDERED, that this petition be, and the same hereby is, granted to the
extent of remanding this proceeding to the Rent Administrator for further
processing in accordance with this order and opinion. The Administrator's
determination shall remain in effect until the Administrator issues a new
Order upon remand.
