ORDER AND OPINION DISMISSING ADMINISTRATIVE APPEAL
The above-named petitioner timely filed an Administrative Appeal against
an order issued on May 30, 1990 by the District Rent Administrator, 92-31
Union Hall Street, Jamaica, New York, concerning the housing
accommodations known as 29-45 Sickles Street, New York, New York, Various
Apartments.
Subsequent thereto, the petitioner filed a petition in the Supreme Court
pursuant to Article 78 of the Civil Practice Law and Rules requesting that
the court direct the Division to determine its administrative appeal.
The Commissioner notes that by a notice dated May 29, 1991, the owner and
the tenants were notified that the Rent Administrator had reopened the
proceeding under Docket No. Ch 530099-OM to reconsider the order issued on
May 30, 1990.
In view of the foregoing, the Commissioner is of the opinion that the
owner's administrative appeal against the May 30, 1990 should be dismissed
as moot. Any party aggrieved by the superceding order will have the
opportunity to file an administrative appeal within thirty-five days after
its date of issuance. The reopened proceeding has been assigned Docket
No. FE 530026-RK.
THEREFORE, in accordance with the provisions of the Rent and Eviction
Regulations for New York City and the Rent Stabilization Law and Code, it
is
ORDERED, that this administrative appeal be, and the same hereby is,
dismissed.
