DHCR Petition for Administrative Review (PAR) Decisions

In 1994, under pressure from tenant advocates, DHCR released approximately 6,000 PAR decisions. After Governor Pataki took office in 1995, DHCR refused to release other decisions in bulk. These decisions generally cover the 1990-1994 period and in many cases do not reflect current law or DHCR practice. The reader is cautioned to be aware of changes to the Rent Stabilization Law, the Rent Stabilization Code and DHCR practice since 1994. Also this database does not include all decisions prior to 1994 as DHCR intentionally withheld many decisions for unknown reasons.

           ORDER AND OPINION DENYING PETITION FOR ADMINISTRATIVE REVIEW

        On February 8, 1991, the above-named  owner  filed  a  Petition  for
        Administrative Review  of  an  order  issued  on  January  23,  1991
        concerning t e  housing  accommodations  relating  to   the   above-
        described docket number.  

        This administrative appeal  is  being  determined  pursuant  to  the
        provisions of 2520.6(r) and 2523.4 of the Rent Stabilization Code.
          
        The issue herein is whether  conditions  upon  which  an  order  was
        issued reducing the rent have been corrected, warranting restoration 
        of the legal regulated rent.

        The Commissioner has reviewed all the evidence in the record and has 
        carefully considered that portion of  the  record  relevant  to  the
        issues raised by the administrative appeal.

        On March 5, 1990, the owner commenced this proceeding  by filing  an
        application to restore rent on the basis of restoration of services.

        On April 24, 1990, the  tenant  answered  the  owner's  application,
        denying inter alia the restoration of all services in question.

        On November 22, 1990 and  November  26,  1990,  inspections  of  the
        subject  housing  accommodation  were  conducted   by   DHCR.    The
        inspector's report confirmed that services have not been restored.

        On January 23, 1991, the Administrator issued an order based on  the
        inspection  report,  denying  the  owner's  application   for   rent
        restoration.

        In  this  petition,  the  owner  contends  that  repairs  have  been
        performed and this case is closed as shown by an  October  22,  1990
        letter from DHCR to the owner.

        The Commissioner is of the opinion  that  this  petition  should  be
        denied.


        The record clearly shows that an inspection of the subject apartment 
        was made prior to the issuance of the order; and that the  inspector
        reported that the services in question were not restored.

        Accordingly, the Commissioner finds the rent reduction warranted and 
        is of the opinion that this petition should be denied.

        The Commissioner notes the owner's contention that DHCR had  already
        closed the case to be without merit.  The letter  proffered  by  the
        owner merely advised the owner "to request restoration  of  rent  by
        filing the enclosed application forms."

        THEREFORE, in accordance with the Rent Stabilization Law  and  Code,
        it is

        ORDERED, that the owner's petition  be,  and  the  same  hereby  is,
        denied, and that the District Rent Administrator's order be, and the 
        same hereby is, affirmed.
