5. Appeals - Time Certain - 7:30 PM

a. Appeal in L-2887/T-3070, 2331 Sacramento St. This a tenant appeal of a Hearing Examiner decision in which rent overcharges collected by the landlord during a specified period of time were offset by the amount of rent the landlord failed to collect during another period because the contract rent was less than the lawful rent ceiling.

b. Appeal in L-2820, 2442 Piedmont Ave., #17. This is a tenant appeal of a Hearing Examiner decision granting capital improvement increases. On appeal the tenant contends that the petition should be decided under the Board's new capital improvement regulations and that the decision of the Hearing examiner is not supported by substantial evidence.
