a. Appeal in L-2836/T-3077, 1625 Blake St. (Continued from March 4, 1996). This is a tenant appeal of a Hearing Examiner decision granting the landlord historically low rent (HLR) adjustments under Regulation 1280. On appeal, the tenant contends that the HLR rent adjustment should not be granted because the Regulation 1113 (Searle) rent adjustment was miscalculated and because rent overcharges were wrongly reduced.
b. Appeal in T-3078, 2560 Sacramento St. This is a tenant appeal of a Hearing Examiner decision which awarded the tenant rent overcharges. The tenant appeals the rent reduction given to compensate for the habitability problems in his unit. The amount of the deduction, however, was stipulated to by the parties and there is no evidence or allegation of duress.
