The landlord a
ppeals the Hearing Examiner's decision to deny the landlord's petition re
questing an increase in the rent ceiling previously established by the Bo
ard in Petition L-2362, which awarded an increase under Regulation 1269
for increased space. In Petition L-2362, the Board had awarded an increa
se in rent and had phased-in the increase pursuant to Regulation 1274(B)
for the existing tenant, since the landlord had failed to produce an agre
ement waiving the phase-in. The decision was not appealed and became fin
al on September 4, 1994. Eleven months thereafter, the instant petition
was filed. The Hearing Examiner interpreted the new petition as a reques
t to treat the lease entered into before Petition L-2632 was filed, as a
waiver of the Regulation 1274 phase-in. She determined that because the
tenant was ignorant of the law when she signed the lease, it did not oper
ate as a waiver.
