TENANT TIP: LEASES AND DEATH Many people are under the misconception that if a tenant becomes too ill to continue living alone or a tenant dies, the lease automatically comes to an end - unfortunately this is not the case. In both cases the lease must be respected and the apartment will have to be sublet. After a death, the lease becomes the responsibility of the deceased's estate. It is up to the executor to find a new tenant to take over the apartment. However, it is always a good idea in this instance to speak to the landlord, since he/she will sometimes agree to break the lease on 30 or 60 days notice. A sure way of avoiding this problem is to become a month-to-month tenant once your lease expires rather than resigning a new agreement. Remember it is your right to be a monthly tenant and the landlord CANNOT evict you. The same terms and conditions of your lease will continue to apply but you need only give 60 days notice if you have to leave - for whatever reason.
