Apartment Refigerators ...?

If you have been in a apartment complex for three years
and you want to replace your (Refrig) because you are having a baby,
and the (refrig) is like 40 years old (non-frost free) what is the law
on this?? Should the Apt Complex Replace it for free or can I say
in L&T (Queens County) thats It's Not working the way it should and to
have it replaced with a frost-free one..???
