Well, let me ask you, why do you want to be on the lease? If it's so you won't get kicked out then that is mostly up to whoever has their name on the lease. As of now your status is strictly as a roommate unless you are in a relationship with the person on the lease. If not, then you are vulnerable only if there is bad blood between yourself and the person on the lease or if that person moves. Now if that person moves then you have to go. That is why NY landlords like to take people off of leases but not add them. The more people on a lease the more they can tie up an apartment, and the more they can pass the buck as far as nonpayment goes.

But in answer to your main question, In NO way is the landlord obligated to add you to the lease. In fact to move in as a roommate you are supposed to give written notice to the landlord.
