YES they can evict you and use it commercially....under a few conditions
That the apartment is absolutly necesary to maintain their business...and not just for convienence
If the management company had an their ONLY office in the building, that was destoryed by fire or flood, that would be a business necessity, but to open a new office because its conveient no way can they do it......
Also if they hired a new super and there is/was no super on the premesis and they wanted to give your apartment to the super..and file an exempt registration... they could have a case.... but also they would have to do it for 3 years or you could sue them for later for an Illegal Eviction...

: We have a one year lease on a rent stabilized apartment in New York City. Our management company has expressed an interest in taking over our apartment for their own commercial use. Do they have any legal right to evict us or are we protected by our lease agreement?
