It sounds as if the landlord failed to show that the work done was substantial rehabilitation, which would have exempted the building from regulation.

Now DHCR is apparently going to set the rent. As many, many postings on this forum have shown, DHCR is a minefield, and unless the tenant is very familiar with these issues, it's a good idea to have a lawyer.
