is if the landlord invest a great deal of money into making capital improvements and repairs to the apartment. To raise the rent this much they would need to be extensive. You can determine what the last stabilised rent was by contacting DHCR. This will tell you what number you would use to determine how much they jacked up the rent. NOW! A landlord may try to get you to swallow the idea that if the market can bare 2000.00 it can be raised to 2000.00 and then be automatically decontrolled but this is not so. The 2000.00 a month rent must be aquired by doing legitimate work and spending the money. You can take the vacancy increases and 1/40th of monies spent on improvements and come up with the figure yourself. By the way, rent riders, that are supposed to be attached to leases, should outline how a landlord came to the current rent.

BUT!!! if you find that you were the very next residential tenant in the apartment after a RENT CONTROLLED tenant vacated then that would make you a "Tenant Lessee" which means that the apartment can be made to match market values IF the "Tenant Lessee" does not file any kind of complaint within.......uh? I think it's 8 months. If no complaint then the current rent becomes the legitimate rent. Again this is the first tenant to move in AFTER a rent controlled tenant vacates.
