My husband and I have a lease thru Sept. We paid first and last month's rent and a security deposit. Due to a change of jobs we have to leave Arizona. Per the written contract, to break the lease we need to pay a buy-out fee in the amount of one month's rent, any incentives we received and we lose the security deposit. After giving notice last month, we've just now been told that we forfeit all refundable deposits- including the last months rent we paid. So now we owe another one month's rent. No where on the contract is that mentioned. Can they do that? The contract doesn't state forfeiture anywhere and they never mentioned that fact until I went to pay the last month's rent.
