rent increase for loft

I live in building in Brooklyn since 2 years with about 10 "lofts", my roomate and I signed a 1 year commercial lease, but everyone in the building actually lives in their loft. I wanted to know about the amount of rent increase we can get every year. After the first year we got a 5% increase, and now we are asked to pay another 5-6%. Although I would guess we're not rent controlled, does the RGB apartment and loft order #31 apply? If so, must we only pay a 1% anual rent increase?

Is it possible to argue against the rent increase with money we had to pay for water damage (leaky roof) and a break in?
