Under the current rent guidelines, for subleases commencing through September 30, 2000, the landlord is not permitted to collect a surcharge for subletting.

Under the proposed guidelines, for subleases commencing October 1, 2000 through September 30, 2001, the landlord would be permitted to collect a 10% surcharge.

In any event, if the apartment is fully furnished, you are permitted to collect and keep a 10% surcharge.

The subtenant should pay the total sub-rent to you, including the 10% furnishing surcharge and whatever subletting surcharge is allowed, and you should pay to the landlord the rent provided for in your lease, plus whatever subletting surcharge is allowed. You keep the furnishing surcharge.

: Can the landlord add any type of surcharge when I sublet my apartment for the rent I pay? I seem to remember having heard something about his right to do so, with the additional amount going directly to him. Can the landlord charge anything over and above my rent and, if so, how much?
