I live in the upstate NY area (Elmira, NY).
I live in a rented house, three bedroom, doesnt include utilities, and has a one year lease.
I was wondering if that my landlord could be held
responsiable for something? For example, the refrigriator
that he provided as an included appliance broke down.
Meaning that I only had a day to get a new one before my
food spoiled. (Considering that I dont have anywhere else
to go to temp store my food). After my fiance contacted
him, it took about 3 days for him to return my fiances
phone call. He told my fiance that he would buy a new one.
Well, finally he droped one off. But he didnt install it.
Infact, he made my 110 lb fiance take out the old one and
then put the new one in. (I was in Boston on business when
this was all taking place). So, when I returned from
Boston, all of the food that I provided for my family while
I was gone was spoiled. I told him, when I got back from
Boston, that I hold him personaly resp for the spoiled
food, and that I deducted 138.00 from the rent to help pay
for the food that was spoiled. He diagreed with me and
threatened me with a 3 day eviction notice if I did not
provide the 138.00. My question is, can he do this. Do I
have some kind of rights here and is he violating any
rights? It seems that this "Evil Landlord" of mine is
trying to take advantage of me. Can you or anyone help me?
