With respect to the 1997 Rent Regulation Reform Act, what DHCR has in its Highlights brochure is "V. Luxury Decontrol. The level for luxury decontrol would be lowered from $250,000 to $175,000 and the minimum rent would be $2,000 per month." I don't see a copy of the legislation itself on the website, so it's hard to know exactly what the phrase "and the minimum rent would be $2000 per month" means. I would be interested to see the legislation itself in light of your noting that the courts have said "no" to deregulating an apartment before someone actually paid $2000 or more. Are these cases available on Tenant Net? Or could you cite what the courts said--like do they note the existence of the 1997 Rent Reform Regulation Act and say it doesn't matter or do they speak as though there was nothing that changed in 1997 except the income level?
