If you continue to withhold your rent, the landlord eventually
will sue you in housing court. If you can document the conditions
in your apartment well, you should be able to ask for a rent
abatement in court for the lack of services in your apartment.
Meanwhile, call HPD at 960-4800 to report your complaints and
ask for an inspection. Written violations of record will help in
court.

: To make a long story short, I moved into a NYC rent-regulated apartment 10/99 and have not paid rent since 1/00 due to such problems as mice infestation, water leaks and damage, no heat/hot water, non-working light fixtures in the kicthen and bathroom, etc. After repeated calls and letters to management and several housing inspections, I sent a certified letter to my landlord notifying them that I would not pay rent until the problems were corrected. I would like the problems fixed, but moreso, I do not want to pay full rent for the months that I had to endure seeing mice running across my bed, in my kitchen sink, and coming out of my backpack on the subway. Any advice? My landlord has made no attempts to collect the months of back rent.
