I find it interesting that James would write that "Even with a good lawyer it is difficult to win a case for subtenants." These kinds of cases are not started unless the likelyhood of success is apparent. Because these kinds of cases are based on indisputable facts -- notably, the prime tenant's real residential address combined with proof of his or her lack of connection to the subtenant's apartment -- they are really not that difficult to win....assuming the facts are on your side. Thus, despite James' contention...illusory tenancy cases are not difficult to win. In fact, I have never lost an illusory tenancy lawsuit.
