Rent Increase and Late Fees

Posted by Frank on September 10, 2000 at 15:08:07:

In May of this year my 1 year lease expired. On May 1, the building manager met me in the garage and asked that I give him a check for the rent...I usually drop it in the mailbox of the manager's unit. He told me the rent would now be $801.74 and that there was also a security deposit increase..the total check should be $842.70. I wrote the check, and continued to pay $801.74 in June, July and August.

On September 1, in my mailbox, I received a notice that my rent was $818, and that I needed to pay the difference for June, July and August as well as $50.00 late fees for each month. I added the difference to the September check, but wrote a letter asking for the late fees to be waived since I hadn't been notified in writing about the increase.

My landlord called stating that he wasn't responsible for notifying me what my rent is, that they had sent a late notice (I never received one.) I told him that had the manager asked me to pay the additional rent in June, or July or August, I would have done so that month and in the future made the correct rent payments.

Now I wonder...am I responsible for the late fees for rental amounts I wasn't told about, and am I even responsible to pay (as I've already done) the extra for June, July and August?

Can I be evicted for not paying the late fees?
