From Today's News Update in the September 27th edition of the New York Law Journal:
The Court of Appeals last week dismissed an appeal of an Appellate Division, First Department ruling in Lang v. Pataki, 567, that upheld the constitutionality of the rent deposit requirement in the Real Property Actions and Proceeding Law. The law prohibits judicial stays on eviction warrants unless a tenant pays back rent or makes a deposit. A June ruling from the Appellate Term, Second Department, in Jones v. Allen, 99-1493 KC, had ruled the opposite.
