Noisy neighbors

My upstairs neighbor (not a bad sort by any means) clearly suffers from sort of obsessive/compulsive syndrome as he rocks back and forth for literally hours at a time atop a loose, creaky board located just above the head of my loft bed. I have complained by letter, in person and via my landlord. Each time the neighbor apologizes thoroughly and with apparent sincerity and each time he resumes his behavior immediately. What exactly does the law say about this? Can I force the management company to install carpeting?
