It would appear that the apartment is not rent stabilized, but the tenant should have checked this out shortly after she signed the lease and moved in. The only two relevant issues clearly are: (1) does the building have four units or more? or (2) if the building has fewer than four units, does the landlord live in the building?

: Well, if the apartment were in fact rent-stabilized the tenants could not evicted on a few days notice, yes?
