Thank you for your helpful feedback. I did actually scour the court decisions, but unfortunately it is not possible to see how the appeals of those decisions turned out - and that is where I think you have to go to actually see if anyone has been able to break through the four year statute of limitations restriction. Does anyone out there know if an court has ever allowed a tenant to do this in an Article 78 hearing or other action?
