: If a tenant in a rent-controlled apartment wins a rent overcharge suit against his landlord and wins treble damages for the overcharge, is the 2/3 portion of the award that exceeds actual damages taxable?

I think punitive damages in lawsuits are usually taxable. But I am not sure if this would be considered punitive damages (or how in heavens name the IRS would find out about 'em).
