It isn't clear whether your legal problems are with the building's owner or with the primary tenant whom you sublet from. No matter. It sounds like you are fed up with the legal nonsense and ready to move on, you just want some reassurance from us.

Moving out sounds like a great idea. But your post isn't clear if the new apartment would be with your same landlord (in which case I'd avoid it) or someone else.

My advice would shop around (if you haven't already) -- check the classifieds, call a few brokers, consider different neighborhoods. You'll soon know if the apartment you've been offered is a deal to take or to pass on. Whatever you do, you'll be able to find a place quickly to move up to.
