In a 4 bedroom apartment in NYC, we had 3 people on the lease (1 year ending Dec 31, 2000). One of the tenants who is on the lease moved out November 4. Even though we had an oral agreement to have someone move into his room and take over the rent for the end of the year (and to be on a new lease starting Jan 1), he has refused to pay past utility and other bills to the remaining occupants. What is his responsibility with regards to rent for the rest of the year? We would like to force him to pay the last two months of the lease -- what is our legal position? This is all not to mention the fact that he moved his girlfriend into the apartment for 6 weeks before he moved out with no notice to the other roommates...
