What you are contemplating is unethical, so don't expect to find any help here. Its called extortion. Carrying out your scheme can get you 3-5 years "rent free" -- in a federal pen.

I don't understand why you have gone to the trouble of suing your landlord to force him to give you a lease, and now you contemplate not siging such a lease. Makes it kind of obvious that your agenda is certainly not to find housing. But to answer your question, an illusory tenancy lawsuit is to compel the landlord to offer you a lease, there are no penalties for the landlord (if there is an overcharge complaint that is usually against the primary tenant).

If you don't want to deal with the landlord in a professional way then I suggest you look for an apartment elsewhere.
