We moved from a rent stabilized apt in brooklyn, NY to California november 2. At that time my wife and landlord walked through the empty apt (we unfortunately did not take pictures), and the landlord said he would return our deposit and took our contact information (a telephone number, since we had no address). When we found an address in california a few weeks later, we called our landlord. In december we called him three times with no responses. Mid December we send a certified letter w/ return receipt asking for our deposit and for him to contact us if there is a problem - no response, no receipt returned.

How do we proceed? Can we start a lawsuit from across the country? Can we have the landlord served? Will this cost more that the $850 security deposit?
