I agree that you need to provide more info--without identifying yourself, of course.
I assume, if I understand you right, that you were supposed to file a form with the DHCR, but you did not get this form in time to file within some kind of 35 day time limit. The "guy" is,I also assume, a DHCR bureau chief.
The failure to reply is not surprising. They are notoriously slow over there.
Based upon the somewhat vague info you're giving, I'd suggest that you file whatever form is required, if you havent done so already, directed to the bureau chief in charge of whatever bureau is involved. You can get his or her name from the DHCR. Explain the extenuating circumstances.
I can't respond to the rest of your post re the lease because it simply is not clear.
