Question of statue of limitations on uncashed rent checks

Posted by Beau on January 26, 2001 at 07:53:59:

Does anyone know if there is a statute of limitations on uncashed rent checks? Our previous landlord where we lived 2 years ago just sent us a letter notifying us she found 3 uncashed rent checks from 1/98, 2/98, and 5/98 and wants us to write out a new check to cover them. The problems is, our lease with that landlord/apartment expired in 4/99 and at that time, the landlord had no outstanding claims against us for unpaid rent. We paid our rent ontime, every month for 8 years without dispute. We feel it is their responsibility to cash the checks on time. Are we obligated under NYC law to now, 3 years later, replace those checks?
