: Manhattan, Lower East Side, Stabilized. 25 apartments in an old tenament (early 1900's).

: I am working freelance out of town and my job has extended to about 9 mo's away from NYC. I have been sub-letting to a friend at no extra cost on top of my NYC rent. We got a letter from our landlords attorney saying my friend had to be out in 15 days or we would lose our lease. Do we have a right to sublet to him while we're away if it is under a year and we are not charging any more than our regular rent?

: Can he be kicked out?

yes, both of you can be evicted... you were supposed to get written approval before you sublet. Read RPL 226b:
