i don't honestly know the laws, but frankly, if you do not have a standing lease, the LL can do whatever he wants to with you. he could raise the rent every day of the month, or paint the floor while you are out. without a contract, you're just a long-term visitor. i'm sure a court would see the relaity of your situation, but there would be less question of your rights if you had a lease. while i think its dumb that the landlord is making current tenants pay retroactive deposits, there's nothing to stop him, unless you have some statment that proves you even gave him a deposit. on th ebright side, a couple of months and $300 later, you'll have a new landlord, and maybe you can get a lease of some sort right off the bat, so they'll be no more surprises!
