In New York, most landlords don't routinely report to credit agencies. There is some kind of reporting agency for landlords, but I am not sure what it is or if it is widely used.
In NY it takes a long time to evict a tenant, even for non-payment.
Also I think you might have a libel problem if a tenant has a justifiable beef with an LL and there is a negative credit report.
In the case of this person, it is unlikely the LL has an arrangement with a credit agency and is very unlikely to sue for eviction in the NY courts.
All things being equal, however, I agree that withholding the last month's rent is usually not advisable.
