it may not be the 'right' thing, but the LL screwed up big if he already handed your money back! sort of an error in your favor. unless he wants to drag this into court, i wouldn't worry. it would proabbly end up costig him more to do that than just eat the cost of the paneling. frankly, if you think of the process of: pay deposit, sign lease, lease ends, deposit returned ... the cycle is complete. anything else should be his problem. i don't see how he could get the money back.

has he been a landlord long? seems to me there should be a chapter in 'landlording for dummies' called "Whatever You Do, Don't Return the Deposit Until You're Sure There's No Damage!!!" anyhow, did he give you back the interest accrued on your deposit? i doubt it. tell him to use that to put up new paneling!
