I LIVE IN SYRACUSE, AND AM HAVING A PROBLEM WITH MY LANDLORD. AFTER MOVING OUT(A 22 DAY NOTICE WAS GIVIN WITH THE AGREEMENT THAT HE COULD TRY TO RENT THE APT WHILE I STILL LIVED THERE- HE DID RENT THE APT AND SOMEONE MOVED IN AS SOON AS I MOVED OUT-. I CALLED AND ASKED ABOUT MY SECURITY DEPOSIT AND HE SENT ME AN ITEMIZED LETTER SAYING THAT I OWED HIM THE SECURITY DEPOSIT PLUS 16.00 FOR PAST DUE WATER BILLS. I NEVER ONCE IN THE THREE YEARS I LIVED THERE RECEIVED A WATER BILL OR ANY MENTION OF A PAST DUE BILL FROM HIM . AND NO OTHER TENANTS ARE PAYING WATER BILLS. SO I CALLED HIM TO ASK HIM ABOUT THIS SITUATION AND HE SAID AGAIN I WAS NOT GETTING THE DEPOSIT DUE TO PAST WATER BILLS. WHEN I QUESTIONED WHY HE NEVER MENTIONED THIS TO ME IN THE THREE YEARS OF LIVING THERE HIS RESPONSE WAS THAT HE DIDNT KNOW I OWED IT UNTIL HE LOOKED AT MY LEASE. I ASKED HIM TO SEND ME A COPY OF MY ORIGINAL SIGNED LEASE AND COPIES OF THE BILLS I OWED FOR THE WATER AND HE SAID OK. A FEW DAYS LATER I RECEIVED A LETTER FROM HIM WITHOUT THE COPIES OF THE WATER BILLS OR THE COPY OF THE SIGNED LEASE AS AGREED ON THE PHONE. AND THIS LETTER NOW STATED THE REASON FOR NOT RETURNING THE LEASE IS DUE TO A LACK OF PROPER NOTIFICATION OF LEAVING, AND THE WATER BILLS ARE A MOOT POINT. MY QUESTION IS CAN HE NOW CHANGE HIS REASON FOR KEEPING THE DEPOSIT, WHEN HIS NEW REASON WASNT EVEN MENTIONED IN THE FIRST LETTER? AND CAN HE CHARGE BOTH THE NEW TENANT AND ME FOR THE SAME MONTH RENT? PLEASE LET ME KNOW WHAT MY RIGHTS HERE ARE. I THANK YOU FOR YOUR HELP .
