do you have a copy of your lease? usually you and the LL sign 2 copies so each has one. or at least make a photocopy. if you don't have your original lease, there's no telling where the truth lies. but that is a pretty strange thing for a LL to do, if it's in the lease or not. he sounds like he's just making excuses to keep your deposit, cuz it'd be so much more work for him to keep track of water bills that pile up over the years. i'm sure he doesn't have any of them, and is just telling you this to keep your money.

and now with this lack of notice thing he's jumping onto another issue to keep your deposit. technically, 23 days is not enough notice (should be 30 days), but most people with an ounce of decency wouldn't be so ornery about it, esp since there's someone moving in right after you. but if your lease is still in effect and has a specific date that it's supposed to end, you are expected to honor that.

so, the water bill thing sounds bogus, but without a copy of your lease, you'll never know. the way it sounds to me, if you can get out of there, only losing your deposit, consider yourself lucky.
