Is this ruling immediately enforceable

I note this was a ruling of a split Appellate Division, which means the Court of Appeals may ultimately rule.

Will it be enforceable if there is an appeal? What should tenants do in the meantime if their landlords wish to apply this ruling? Ignore it and file a rent overcharge complaint (in hopes the Court of Appeals will overturn the ruling?)
