Gaining full tenancy in an illusory sublet by landlord

Can a tenant in a landlord-created illusory sublet (apartment sublet by phantom 'tenant,' transaction handled entirely by landlord) sue to become the legal tenant in the apartment -- or are legal recourses limited to fraud, rent overcharges, etc.?

If establishing tenancy is possible, does a DHCR procedure exist for this, or can it only be done in Housing Court?
