The broker is not supposed to cash the commission until the lease is signed by both parties. The broker is breaking the law. Call the NY State Department of licenses in Albany and find out how to file a complaint. You will not only get your money back, the broker may also lose their license. Is brokers like this that give brokers a bad name.
