What happens is that he is breaking the law.

You should have gotten a renewal lease 90 days (it used to be 120) before expiration of lease. If he gives you the renewal lease past that deadline, the starting date of the lease must be adjusted forward.
If he gives you any trouble on any of the above, complain to the DHCR--failure to furnish a proper lease.
