Didn't you just post as Lori? Check with the department of buildings for the Certificate of Occupancy. If the apt is illegal the city could conceivably order the LL to evict the tenant in the illegal apt. So could the fire department. After you have lived there for 30 days, the only way LL can evict you is through the courts. On the main page here at tenant.net scroll down towards the bottom and look for the "Illegal Eviction and Police Procedure" After you've been there longer than 30 days, pay by check-LL can't do a thing about it. Send it certified mail, return receipt. If LL doesn't cash it, you will have proof that you tendered it.
