I haven't been through this in quite some time but... when my mother died, the LL was so hot to get his hands on her rent control apartment, he gave us a week or ten days to remove her belongings, without charging us rent for the additional time. I don't think he ever returned her security deposit though.

I'd suggest talking to your LL before you go to the Buildings Department or any other city/state agency.
