Yes, this person was lucky in that the landlord chose not to pursue the case. But if the landlord did, and lost, he'd get treble damages. So there is a bit more than luck involved.
There is no such disincentive for the tenant to pursue the case.


: Well you're lucky. Lucky in that your LL chose not to persue the matter. Other LL's may chose to do so. Right now it appears to depend upon the language referencing the preferential rent in your original lease and subsequent renewal lease(s).
