Technically, it seems that the new person moving in would be a "roommate", not a "subletter".
A "subletter" would be taking over the entire lease.
It doesn't seem that rules on "roommates" are codified to the extent that you are asking about.


: i live in a stabilized 3BR and one roommate plans to leave for a year. he wants to name the subletter without consulting either myself or the other roommate. all three of us are on the lease. is there any legal premise which could prevent that, or at least mandate that the other people living in the apartment have to have some say in who they live with? (we don't get along, as you may have guessed, and the last thing i want is to live with one of his buddies).
