Turns out I was wrong and it's rent-stabilized; I talked to a lawyer today and he says I have an open-and-shut rent overcharge case, but that I shouldn't expect to be able to take over the lease based on the "illusory primary tenant" situation. I am named in the landlord's suit against the primary tenant, but I'm unsure whether that means I'm at risk for a judgment against me (e.g., for use/occupancy fees during the time past the lease expiration). The landlord has structured his case in part around the primary tenant's overcharge of us subtenants--saying that it's a violation of the terms of the lease.
