Well not so fast: The LL re-rented the apt right away therefore there was no loss to him. I believe the LL has been unjustly enriched in this instance. I would take him to court, and the venue is VIRGINIA, where you, the plaintiff, resides.
This lease provision is to protect the LL against damages and loss of income; in this instance there is neither, other than LLs minor costs (advertising?) associated with re-renting the apt. GO for it!
