Are there building code violations in your apartment? Have you requested repairs that have not been done? Have you been to court yet?If so, did you request an inspection? If there are violations in your apt, take pix and bring them to court and request the inspection. It shouldn't be dismissed if there are violations in your apartment.
Your LL's attorney is just trying to scare you off. If for some ungodly reason it is dismissed, file it again. If you lose, you have to pay his fees, and visa versa, but don't worry about that now.
