When the tenant on the lease told me I'd have to leave b/c the LL was trying to evict her, I called the LL to try to save my own ass (begged to stay in the apt at no avail), and that's when he told me I was paying the tenant on the lease more than the stabilized rent. I got a rent history of the apt from the DHCR, which confirmed what the LL told me. In the past, when I inquired about the rent, she led me to believe I was only paying a little more than she was.

Is small claims still feasible now that she lives upstate NY?
